These Terms of Use (the “Terms”) are a binding agreement between you and Arky Korea Inc. (“Arky,” “we,” or “us”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.
1. Scope and Acceptance of Terms
These Terms apply to your use of all online services provided by the Company, including our websites, applications, APIs, and any ancillary features (collectively, the “Services”).
You become subject to these Terms by indicating your consent during account registration or by otherwise accessing or using the Services.
The Company may amend these Terms in compliance with applicable laws. We will notify you of the revised Terms and their effective date at least seven (7) days in advance via in-Service notice or email. If you continue to use the Services through the effective date without objection, you will be deemed to have accepted the amended Terms.
2. Definitions
For purposes of these Terms, the following terms have the meanings set out below:
“User” means any individual who uses the Services, whether or not they have registered an account.
“Account” means the identifier and associated credentials created to identify a User and enable use of the Services.
“Input Data” means any materials a User uploads or provides to the Services, including without limitation text, files, images, prompts, and similar items.
“Output Data” means results generated by the Services (including AI functionality) based on Input Data or other materials.
“User Content” means all content a User creates, uploads, posts, or shares within the Services.
“Paid Subscription” means a contract under which fees are paid to use the Services for a specified period.
“Beta Features” means features provided in an experimental or pre-release state.
3. Eligibility and Accounts
You must be at least fourteen (14) years of age to use the Services. If you are under 14, consent from a parent or legal guardian is required.
You must create your Account using your own information and are responsible for maintaining the security of your Account.
You may not transfer or lend your Account to any third party.
The Company may restrict, suspend, or terminate your Account if you violate these Terms or applicable laws, or if your use threatens the security of the Services.
Subject to your compliance with these Terms and our policies, the Company grants you a personal, non-transferable, non-exclusive license to use the Services.
Without our prior written consent, you may not resell, lease, rent, frame, scrape, or otherwise make commercial use of the Services or any part thereof.
4. Account Registration and Security
- You must provide accurate, complete, and up-to-date information when creating your Account.
- You must safeguard your login credentials and are responsible for all activities that occur under your Account.
- You may not share, transfer, or sell your Account without our prior written consent.
- If you use a third-party sign-in method (e.g., Google, GitHub), you authorize us to access the account information necessary to provide the Services.
5. Acceptable Use
You agree not to do the following:
Violate any applicable laws or regulations;
Upload, share, or store content that is unlawful, harmful, defamatory, obscene, infringing, or otherwise inappropriate;
Misuse the Services to generate illegal or harmful AI outputs;
Interfere with the operation of the Services or attempt to gain unauthorized access;
Use bots, crawlers, or other automated systems without our prior written permission;
Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Services.
A violation of this Section may result in suspension or termination of your Account.
6. Intellectual Property
Your Content: You retain ownership of the documents, text, and other content you create (“User Data”). You grant Arky a worldwide, non-exclusive, royalty-free license to store, process, and display your User Data solely for providing and improving the Services.
Our Content: The Services, including software, designs, and documentation, are owned by Arky and protected under copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.
7. AI-Generated Content
- The Services may generate various outputs (“Output Data”), such as text or summaries, using artificial intelligence based on your inputs (“Input Data”).
- Output Data may contain inaccuracies or bias, and you are responsible for independently verifying its accuracy before relying on it.
- Output Data is not guaranteed to be unique and may be similar to results provided to other users.
- Rights in the Output Data vest in you; however, the Company may internally use user data in an anonymized and aggregated form that does not identify any individual for the purpose of improving the Services and our AI systems.
- To the maximum extent permitted by law, the Company is not liable for any consequences arising from your reliance on Output Data.
- The Services and AI outputs must not be used for high-risk purposes—such as medical, legal, or financial decision-making, or any use that could materially affect life or safety—and they do not constitute professional advice.
8. Payment & Subscriptions
Certain features are offered as paid services (the “Paid Services”). Pricing and payment terms are disclosed at the time of purchase.
Paid subscriptions automatically renew at the end of each term. We will notify you of the upcoming renewal and the applicable amount at least seven (7) days in advance by email or in-Service notice.
Paid Services may be billed on a recurring basis until you cancel.
If a free trial is set to convert to a paid plan, we will obtain your additional, express consent prior to conversion; if you do not consent, no charges will be made.
Except where required by applicable law, all fees are non-refundable.
You may cancel at any time through your account settings. Upon cancellation, you will continue to have access to the Paid Services through the end of the then-current billing period.
We may change prices upon prior notice.
Because digital content is supplied, the right to withdraw/cancel may be restricted once provision has begun. However, in the event of a billing error or duplicate charge attributable to us, we will refund the full amount.
If a material service outage attributable to the Company continues for an extended period, compensation or refunds will be provided in accordance with applicable laws and our separate policies.
9. Termination
- We may suspend or terminate your Account if you violate these Terms or applicable laws, or if you engage in conduct that harms or threatens the Services.
- Upon termination, your access to the Services will cease, and your user data may be deleted unless retention is required by law.
- The provisions on payment obligations, intellectual property, disclaimers, and limitations of liability (among others) will survive termination.
10. Data Access, Retention, and Deletion (Export & SLA)
- Before termination, you may download a copy of your data within a reasonable period using the export functionality provided by the Services.
- Following account termination or service discontinuation, the Company will retain data in a minimal form for backup and audit purposes for up to sixty (60) days, after which it will be securely and permanently deleted.
- Information that must be retained under applicable laws will be kept only for the legally required period. Once deletion is complete, the data cannot be recovered. We will provide reasonable notice of the timing and scope of deletion.
Disclaimer of Warranties; Limitation of Liability
The Services are provided “as is” and “as available,” and, to the maximum extent permitted by law, the Company expressly disclaims all warranties—whether express, implied, or statutory—including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or similar economic loss.
The Company’s aggregate liability for all claims shall not exceed the amount actually paid by you for the Services during the twelve (12) months preceding the event giving rise to the claim.
The foregoing limitations do not apply to damages resulting from the Company’s willful misconduct or gross negligence, or where otherwise prohibited by applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (i) your use of the Services, (ii) your violation of these Terms or applicable law, or (iii) your infringement or misappropriation of any third-party rights.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Seoul Central District Court.

서비스 이용약관 (국문)

본 약관은 주식회사 아키코리아(이하 “Arky”, “당사” 또는 “우리”)와 귀하 간에 체결되는 법적 계약입니다. 귀하가 서비스를 이용하거나 접근하는 경우, 귀하는 본 약관 및 개인정보처리방침에 동의하는 것으로 간주됩니다. 이에 동의하지 않는 경우, 서비스를 이용할 수 없습니다.
1. 목적 및 동의
본 약관은 회사가 제공하는 웹사이트, 애플리케이션, API, 기타 부가 기능을 포함한 일체의 온라인 서비스(이하 “서비스”) 이용에 적용됩니다.
이용자는 회원가입 또는 서비스 이용 과정에서 본 약관에 동의함으로써 약관의 적용을 받습니다.
회사는 관련 법령을 준수하며 약관을 개정할 수 있습니다. 개정 시 개정 내용과 발효일을 서비스 내 공지 또는 이메일로 최소 7일 전에 고지합니다. 이용자가 발효일까지 이의 제기 없이 서비스를 계속 이용하면 개정 약관에 동의한 것으로 봅니다.
2. 정의
본 약관에서 사용하는 용어의 의미는 다음과 같습니다.
“이용자”는 회원가입 여부와 무관하게 서비스를 이용하는 모든 자를 말합니다.
“계정”은 이용자 식별과 서비스 이용을 위해 생성된 식별 체계를 말합니다.
“입력 데이터”는 이용자가 서비스에 업로드하거나 제공하는 텍스트, 파일, 이미지, 프롬프트 등 일체의 자료를 말합니다.
“출력 데이터”는 서비스(인공지능 기능 포함)가 입력 데이터 또는 기타 자료를 바탕으로 생성한 결과물을 말합니다.
“이용자 콘텐츠”는 이용자가 서비스 내에서 생성, 업로드, 게시, 공유하는 모든 콘텐츠를 말합니다.
“유료 구독”은 일정 금액을 지불하고 일정 기간 동안 서비스를 이용할 수 있는 계약을 말합니다.
“베타 기능”은 시험 또는 사전 공개 상태로 제공되는 기능을 말합니다.
3. 자격 및 계정
이용자는 원칙적으로 만 14세 이상이어야 합니다. 만 14세 미만인 경우 법정대리인의 동의가 필요합니다.
이용자는 본인 정보로 계정을 생성해야 하며, 계정 보안 유지에 책임을 집니다.
이용자는 계정을 양도하거나 대여할 수 없습니다.
회사는 이용자가 약관이나 법령을 위반하거나 서비스 보안을 위협하는 경우 계정을 제한, 정지 또는 해지할 수 있습니다.
회사는 이용자에게 본 약관 및 정책을 준수하는 범위에서 서비스에 대한 개인적이고 양도 불가능하며 비독점적인 이용권을 부여합니다.
서비스 또는 그 일부에 대한 재판매, 리스, 임대, 프레임, 스크래핑 등 상업적 이용은 사전 서면 허가 없이는 금지됩니다.
4. 계정 등록 및 보안
계정을 생성할 때 정확하고 완전하며 최신의 정보를 제공해야 합니다.
로그인 자격 증명을 안전하게 관리해야 하며, 귀하의 계정에서 발생하는 모든 활동에 대해 책임을 집니다.
당사의 사전 서면 동의 없이 계정을 공유, 양도 또는 판매할 수 없습니다.
Google, GitHub 등 제3자 로그인 방식을 이용하는 경우, 귀하는 당사가 서비스 제공에 필요한 해당 계정 정보를 접근하는 것을 허용합니다.
5. 허용되는 사용
귀하는 다음과 같은 행위를 하지 않을 것에 동의합니다.
관련 법률 또는 규정을 위반하는 행위
불법적, 유해, 명예훼손, 외설적, 권리침해 또는 기타 부적절한 콘텐츠를 업로드·공유·저장하는 행위
불법적이거나 유해한 AI 출력물을 생성하기 위해 서비스를 악용하는 행위
서비스의 운영을 방해하거나 무단 접근을 시도하는 행위
당사의 서면 허가 없이 봇, 크롤러 또는 자동화 시스템을 사용하는 행위
서비스의 소스코드를 역설계, 디컴파일 또는 기타 방법으로 취득하려는 행위
이 조항을 위반하는 경우, 귀하의 계정이 정지 또는 해지될 수 있습니다.
6. 지식재산권
귀하의 콘텐츠: 귀하는 귀하가 생성한 문서, 텍스트, 기타 콘텐츠(“이용자 콘텐츠”)에 대한 소유권을 유지합니다. 단, 당사는 서비스 제공 및 개선을 위해 귀하의 사용자 데이터를 저장·처리·표시할 수 있는 전 세계적, 비독점적, 로열티 없는 라이선스를 가집니다.
당사의 콘텐츠: 소프트웨어, 디자인, 문서 등을 포함한 서비스는 Arky의 소유이며 저작권법, 상표법 등 관련 지식재산권 법률의 보호를 받습니다. 당사의 서면 동의 없이 이를 복사, 수정, 배포, 파생 저작물 작성하는 행위를 할 수 없습니다.
7. 인공지능(AI) 생성 콘텐츠
본 서비스는 귀하의 입력(“입력 데이터”)을 기반으로 인공지능을 통해 텍스트, 요약 등 다양한 출력물(“출력 데이터”)을 생성할 수 있습니다.
출력물에는 부정확성이나 편향이 포함될 수 있으며, 이를 활용하기 전에 반드시 귀하가 정확성을 검증해야 합니다.
출력물은 고유성을 보장하지 않으며, 다른 사용자에게 유사한 결과가 제공될 수 있습니다.
출력물의 권리는 귀하에게 귀속되지만, 당사는 서비스 및 AI 시스템 개선을 위해 개인정보가 식별되지 않는 익명·집계 형태의 사용자 데이터를 내부적으로 활용할 수 있습니다.
출력물을 신뢰하여 발생하는 결과에 대해 Arky는 법이 허용하는 범위 내에서 책임지지 않습니다.
본 서비스 및 AI 산출물은 의료·법률·재무 등 고위험 목적이나 생명·안전에 중대한 영향을 미칠 수 있는 용도에 사용되지 않아야 하며, 전문 자문을 대체하지 않습니다.
8. 결제 및 구독
일부 기능은 유료 서비스(“유료 서비스”)로 제공됩니다. 가격 및 결제 조건은 구매 시 명시됩니다.
유료 구독은 기간 만료 시 자동 갱신됩니다. 회사는 갱신 7일 전에 갱신 예정 사실과 금액을 이메일 또는 서비스 내 알림으로 고지합니다.
유료 서비스는 해지 전까지 정기적으로 청구될 수 있습니다.
무료체험이 유료로 전환되는 경우, 전환 전에 이용자의 추가 동의를 받습니다. 이용자가 동의하지 않으면 유료 전환되지 않습니다.
모든 요금은 관련 법령에서 요구하는 경우를 제외하고 환불되지 않습니다.
귀하는 계정 설정을 통해 언제든 구독을 해지할 수 있으며, 해지 시 현재 결제 주기 종료 시까지 서비스 이용이 가능합니다.
당사는 사전 공지 후 요금을 변경할 수 있습니다.
디지털 콘텐츠 특성상 제공이 개시된 후에는 청약철회가 제한될 수 있습니다. 다만 과금 오류, 이중 결제와 같은 명백한 과실이 확인되는 경우 전액 환불합니다.
중대한 서비스 장애가 회사의 귀책으로 장기간 지속되는 경우 관계 법령 및 별도 정책에 따라 보상 또는 환불을 제공합니다.
9. 서비스 가용성 및 변경
당사는 안정적인 서비스 제공을 위해 최선을 다하지만, 서비스의 무중단 또는 오류 없음을 보장하지 않습니다. 필요 시 합리적인 사전 통지 후 서비스의 일부 또는 전체를 수정·중단할 수 있습니다.
10. 해지
귀하가 본 약관, 관련 법률, 또는 서비스에 해를 끼치는 행위를 한 경우, 당사는 계정을 정지 또는 해지할 수 있습니다.
해지 시 귀하의 서비스 접근이 종료되며, 법률상 보관 의무가 없는 한 사용자 데이터는 삭제될 수 있습니다.
결제 의무, 지식재산권, 면책, 책임 제한 등의 조항은 해지 이후에도 유효합니다.
11. 데이터 접근, 보관 및 삭제 (Export 및 SLA)
이용자는 해지 전에 합리적인 기간 내 서비스가 제공하는 내보내기 기능을 통해 데이터 사본을 다운로드할 수 있습니다.
계정 해지 또는 서비스 종료 후 회사는 백업 및 감사 목적을 위해 최대 60일간 최소한으로 데이터를 보관한 뒤 안전하게 영구 삭제합니다. 다만 법령상 보관 의무가 있는 정보는 그 기간 동안만 보관합니다.
삭제가 완료되면 복구가 불가능합니다. 삭제 시점과 범위는 합리적인 방법으로 고지됩니다.
12. 보증의 부인 및 책임
서비스는 현 상태 그대로 제공되며, 상품성, 특정 목적 적합성, 비침해에 대한 묵시적 보증을 포함하여 법이 허용하는 한도 내에서 모든 보증을 명시적으로 부인합니다.
회사는 간접적, 부수적, 특별, 결과적 손해 또는 이익 손실에 대해 책임을 지지 않습니다.
회사의 총 책임은 이용자가 최근 12개월 동안 서비스 이용을 위해 실제로 지불한 금액을 한도로 합니다.
위 책임 제한은 고의 또는 중대한 과실로 인한 손해에는 적용되지 않습니다.
13. 면책
귀하는 서비스 이용, 약관 위반, 제3자의 권리 침해로 인해 발생하는 모든 청구, 손해, 책임, 비용에 대해 당사 및 그 임직원, 대리인을 면책하고 보호하는 데 동의합니다.
14. 준거법 및 분쟁 해결
본 약관은 대한민국 법률에 따라 해석되며, 이에 따른 모든 분쟁은 서울중앙지방법원을 전속 관할 법원으로 합니다.
